It is forbidden for a professional, directly or through a third party acting on his or her behalf, to telephone a consumer registered on this list, except in the case of a pre-existing contractual relationship. Any professional canvassing consumers by telephone must therefore notify the Bloctel service. They must do so before any commercial prospecting campaign, and at least once a month if the campaign lasts more than 30 days, to ensure that their commercial prospecting files comply with the telephone anti-solicitation list. Any modification to the file (addition and/or modification of numbers) must be referred to the Bloctel service. For the purposes of this obligation, any natural or legal person who contracts with a consumer is considered to be a professional.

Similarly, it is forbidden to rent or sell files containing telephone data and including the contact details of one or more consumers registered on the opposition to telephone canvassing list. Any professional who adds to or makes available to other professionals a commercial prospecting file must notify the Bloctel service. This must be done before any file is made available, to ensure that the files comply with the « no cold calling » list.
If a file containing telephone data is rented or sold from one professional to another, each professional must refer the matter to the Bloctel service on his or her own behalf.

A professional cannot ask a service provider to contract directly with Bloctel on his behalf. Subscriptions must be taken out directly by each professional.

On the other hand, a professional may delegate a service provider to carry out the processing, but only from an account subscribed and paid for by him/her, and under his/her sole and entire responsibility.
These provisions do not exempt professionals from complying with other legislation in force, in particular the French Data Protection Act (Loi Informatique et Libertés).
